I noticed that you were using different versions… 

"At one point we had noticed that the “pivot point” or “center point” of the shark was positioned so that it would not sink into the sand when added to a scene. However, over time, we found that having the pivot point way below the body caused problems with instructions such as "point at" and "orient to" ...  So the decision was made to relocate the center for the shark... and there were some other object as well... though at this time we do not recall which ones they were." (Wanda Dann)

What you are seeing is a result of two different software versions using sharks with different pivot points.
